With the Leading Member trust deed, unlike any other deed, all initial members sign the document and consent to being members and acting as trustee/director of the corporate trustee and abide by all the rules. This is the same as a member appointment as you will see in the member appointment documentation for members post establishment. Our legal firm has advised that having it in the deed is a lot stronger and the promise for the member to abide by the rules of the deed secured with the member witnessing the deed. In addition there can be no argument that the initial members are party to the fund - which is not the case with a stand alone application form.
